1. Purpose

These terms of use (« Terms ») govern access to and use of the website and MGF.AI service (the « Service »), operated from France, offering dialogue and creation experiences with virtual characters (official or user-created). By creating an account or using the Service, you accept these Terms without reservation.

2. Sweet, Premium and Adult Mode (After Dark) offers

The Service is presented in SFW mode by default (« Sweet »), with a portion available free of charge and a deliberately softer tone on public surfaces. Advanced features, virtual currency (« tokens ») and/or a subscription (« Premium ») may be offered. Adult Mode (explicit content, « After Dark » area) is optional: it is not automatically enabled upon Premium purchase and, when the product requires it, requires age verification through a third-party provider (see age verification policy) in addition to Premium or other planned access. Prices displayed at checkout prevail.

3. Access conditions and territories

The Service is reserved for adults (18 years or older) in your country of residence. There is no default geographic marketing targeting, but access may be restricted from certain jurisdictions where local law would be incompatible with adult-only content or the Service — see Languages and territories and the Minors policy page.

You agree to provide accurate information when registering and to keep your credentials confidential. Any activity performed from your account is deemed to have been performed by you.

4. Official characters, user creations (UGC) and visibility

The Service offers official characters and allows user creations (characters, scenarios, generated content). Creations are generally in private visibility. Publishing to the « Discover » area (community public status) is subject to review by the team: until accepted, the character remains private to other users (see compliance and risks). You remain responsible for compliance with the law and these Terms; the community guidelines and prohibited content page describe expected behaviour.

5. Nature of the Service and content

MGF.AI offers fictional characters and responses generated by artificial intelligence models. Content produced (text, images depending on features) is fiction or simulation: it does not constitute medical, legal, psychological, financial or professional advice, nor a real relationship with a physical person.

You acknowledge that AI outputs may be inaccurate, incomplete or inappropriate. You use the Service at your own risk, in compliance with applicable laws and these Terms.

6. Payments, subscriptions and providers

Payments and subscriptions are processed by a third-party payment provider (identified at checkout on the payment screen, including providers specialised in regulated sectors when we use them). You accept that provider's contractual terms for the transactional part. We do not generally store your full card number on our own application servers; payment data is handled according to the provider's standards. Provider information: /legal/contact-billing.

Rules for billing, cancellation, partial or full refunds and use of tokens are set out on the Refunds, cancellations and tokens page, subject to mandatory rights. Subscription renewal management may be performed from the dedicated area when the provider is enabled: see Subscription / cancellation (documentary path in site configuration).

Target response time for general or billing requests (excluding security emergencies): Sous 2 jours ouvrés.

7. Prohibited conduct

The following is notably prohibited:

• circumventing the Service's security, access or payment measures;
• using the Service for illegal purposes, to harass, threaten or harm others;
• attempting to extract data at scale or overload infrastructure (abusive scraping, unauthorised bots);
• reselling or redistributing the Service without prior written agreement from the publisher;
• creating, requesting or attempting to generate prohibited content, notably involving minors, non-consensual sexual activity, deepfakes or unauthorised likenesses of real persons, incest, bestiality, illegal activities, hate speech or any other category listed in the prohibited content policy.

The publisher may suspend or close an account in case of serious or repeated breach. To report content or behaviour: Reporting (target processing time: Examen initial sous 3 jours ouvrés ; résolution des plaintes sous 5 jours ouvrés).

8. Intellectual property

Service elements (brand, interface, interface text, software base, etc.) remain the property of the publisher or its licensors. Unless otherwise stated on the site, rights in creations you publish within the Service (UGC) are subject to the rules displayed at publication; unauthorised commercial reuse may be prohibited.

9. Personal data

Data processing is described in the privacy policy. Cookies and trackers are detailed in the cookie policy.

10. Limitation of liability

To the extent permitted by law, the publisher shall not be liable for indirect damages, loss of data, loss of business or moral prejudice resulting from use or inability to use the Service. The Service is provided « as is »; continuous availability is not guaranteed (maintenance, outages, dependence on third-party providers).

11. Changes to the Terms

The Terms may be updated. The applicable version is the one published on the site. For material changes, notice on the site or by email may be used where required by law.

12. Governing law, disputes and mediation

Unless mandatory provision to the contrary, these Terms are governed by French law. In case of dispute, and failing amicable resolution, the competent courts shall be those of the publisher's jurisdiction, subject to specific jurisdiction rules (notably for consumers).

12.1 Consumer mediation

Conformément aux dispositions du Code de la consommation concernant le processus de médiation des litiges de la consommation, après nous avoir sollicités et à défaut de réponse satisfaisante, vous avez la possibilité de recourir gratuitement à une procédure de médiation de la consommation auprès de CM2C.
